Host Families and Au Pairs
TERMS AND CONDITIONS BASIS OF AGREEMENT Please read carefully these terms and conditions of ninetonine world, connecting cultures differently (Limited), a company incorporated in England and Wales (Registration No: 9247835).
These Terms and Conditions are a binding legal agreement between ninetonine world, and the Au Pair in (with overnight stay) or Au Pair out (without overnight stay) or the Host Family.
These shall apply to all contracts, to your use of the ninetonine world website and to all services we provide to you.
If, for any reason, you do not agree to these Terms and Conditions you will not be entitled to receive any services from us.
By submitting your application and registering with ninetonine world you confirm that you have read and agree to the full content of the website, that you meet all the requirements to be a Host Family, Au Pair in or Au Pair out, that you have answered all questions honestly and that all information provided, including references, is truthful and current.
ninetonine world will send to the Host Families, the information it has on the potential Au Pair candidates that best fit their profile and vice versa, and they will be solely responsible for accepting or rejecting the offers made to them, excluding ninetonine world from any responsibility.
Therefore, we recommend that you carefully read the profiles and documentation of the Au Pair in or Au Pair out candidates sent to us and make sure that they match what you are really looking for.
The data that the clients obtain from the Host Families or “Au Pair in or Au pair out” are strictly confidential, so it is strictly forbidden to provide them to third parties. Host Families, Au Pair in or Au Pair out who accept these Terms and Conditions are also accepting the contents of our Data Protection Policy, which can be consulted on our website. The family will be able to interview one or more proposed Au Pair in or Au pair out. Interviews will be conducted by skype or in person so that both parties can get to know each other before reaching an agreement. ninetonine world does not guarantee either the start date of the Au Pair in or Au pair out or the duration of the stay with the Host Family. It also does not guarantee the time of the selection process and the closing of the agreement. What ninetonine world does guarantee is that it will make every effort to find the Au Pair in or Au Pair out that fits your profile as soon as possible. The responsibility for the final decision and agreement with a “ninetonine Au Pair in or out” lies with the host family.
ninetonine world acts only as a selection agent that puts host families in contact with young Au Pair in or Au Pair out candidates.
Therefore, in no case are au pairs hired by ninetonine world, but are chosen by the families themselves.
The management fee paid to ninetonine world corresponds exclusively to the contact between both parties.
The rights and obligations of the au pair and the host family are listed on our website and must also be written and signed by both parties in the agreement between Au Pair in or Au Pair out and host family. ninetonine world reserves the right to revise and modify these Terms and Conditions at any time without specifying the reasons. It is your responsibility to visit our website periodically to check the current Terms and Conditions, as these are binding and may have changed since you first contacted the agency.
DESCRIPTION OF SERVICES ninetonine world offers you its services to find an Au Pair in or Au Pair out through its website: www.ninetonineworld.com, email, postal mail or in person at its offices.
ninetonine world makes every effort to find you the most suitable Au Pair in or Au pair out or Host Family; it takes care of all the necessary paperwork; it carefully checks all references and sends you all the documentation of those Au Pair in or Au pair out or Host Families that it considers will best suit your needs.
However, as already mentioned, all responsibility for the final agreement with an Au Pair in or Au Pair out candidate rests with the Host Family.
Our bilingual team offers you a personalized service, helping you every step of the way in choosing an Au Pair in or Au pair out or Host Family.
We are available throughout the Au Pair’s stay to assist both parties at any time.
FEES AND PAYMENT The Host Family will pay ninetonine world a deposit as a registration fee for the au pair program.
This will be applied to administration costs and will be refundable only 50% and exclusively if ninetonine world does not find suitable candidates.
The rest of the fee will be paid once the agreement between the Au Pair in or Au Pair out and the host family has been signed and before the Au Pair arrives at the host family’s home.
In the event that payment is not made within this period of time, the client (the host family) will automatically be out of the program and the other party to the agreement will become available again.
Unless prior notice is given to ninetonine world with justified cause.
ninetonine world reserves the right to take any legal action it deems appropriate against clients who fail to pay the corresponding fee or who have made a fraudulent payment.
Fees for host families will depend on the period of time they will need the au pair.
In the event that this period is extended by mutual agreement, the agency must be notified as soon as it is decided.
This fee will be charged to the host family with a 10% discount on the previously paid fee.
ninetonine world reserves the right to modify the rates at any time, either increases or special offers.
It is the client’s responsibility to check the current rates on the website at any given time before the service is required.
The client must ensure in advance that he/she has the solvency to pay for the services to ninetonine world.
These terms are in accordance with the English legal system and failure to comply with them may result in legal proceedings.
REFUNDS AND REPLACEMENTS If the Host Family decides to terminate the placement as a result of serious misconduct on the part of the au pair, the client must inform ninetonine world as soon as possible (minimum two weeks). ninetonine world, after communication with both parties, reserves the right to decide what constitutes serious misconduct and whether the client is entitled to a replacement and/or refund.
In the event that ninetonine world considers it appropriate to replace a family or au pair, it cannot guarantee that candidates will be available immediately but will try to give these clients priority over new ones.
We offer families and au pairs a one month guarantee from the start date of the au pair’s stay.
During this time, should problems arise between the two parties, ninetonine world may offer a replacement host family and a new host family to the au pair in accordance with the provisions of these Terms and Conditions.
At the expiration of the guarantee period, the contract shall be considered satisfactory and binding and ninetonine world shall be deemed to have fulfilled all its obligations.
Should it suspend its services after the end of the guarantee period, netoninineworld may, at its sole discretion, charge the customer again.
TERMINATION OF THE AGREEMENT: PREAVISO OR MISCONDUCT There may be several cases for termination of the agreement.
ninetonine world is aware that each case is unique, so it will study the particular case and will try to resolve it in the fairest way possible and mediate in the best possible way.
In case of incompatibility, genuine incomprehension or incompetence on the part of your ninetonine world au pair and after discussion with us.
If a solution is not reached and the au pair program needs to be terminated, the two-week notice period will begin, where according to the program guidelines, the au pair will perform his/her normal duties and the host family will continue to fulfill everything agreed with the au pair (room, board, pocket money, etc.).
Both parties must give each other the notice period established in the contract signed by the ninetonine world au pair and the host family, and must in any case notify ninetonine world in writing of the reasons for giving such notice.
If this notice period is not complied with by the family, the family will be liable to pay in cash to their au pair the amount corresponding to 2 weeks pocket money, board and lodging during this period, plus additional return travel expenses should they arise from the early termination of the placement.
Except due to extreme circumstances, if the ninetonine au pair leaves the host family without respecting the notice, the ninetonine au pair will lose his/her right to be assisted by ninetonine world and will have withdrawn from the ninetonine world program and will be liable for any damage or harm that his/her abandonment may cause ninetonine world, even if the host family and the ninetonine world au pair reach a mutual agreement for the ninetonine world au pair to leave the home without respecting the notice, the host family shall give him/her time to find another family or make the necessary arrangements to return to his/her country.
In the event of misconduct on the part of the host family or the ninetonine world au pair, the other party must terminate the commitment immediately.
Misconduct involving risk or danger will require the intervention of the police.
Both parties must inform ninetonine world immediately so that it can take the measures it deems appropriate. In case of misconduct on the part of the ninetonine au pair, he/she will be expelled from the program and will have to bear the costs of returning to his/her country.
In these cases, the host family will be responsible for providing accommodation for one (1) day from the end of the program.
We recommend that the ninetonine au pair contact ninetonine world to facilitate his/her return.
If the ninetonine world au pair leaves due to misconduct on the part of the host family, the host family is obliged to provide and pay for suitable accommodation and maintenance for two (2) days from the time the ninetonine world au pair leaves the house.
The host family is also obliged to make the necessary arrangements and pay for the return trip to his/her country of origin if, during those two (2) days, ninetonine world does not find a suitable host family for him/her or if he/she decides to return home.
In case of non-compliance, ninetonine world reserves the right to take legal action against the host family.
LIMITATION OF LIABILITY CLIENT’S RESPONSIBILITY ninetonine world is only responsible for the search, selection process and replacement in case of need.
In other words, it will provide an intermediary service.
The host family and the ninetonine au pair by accepting these Terms and Conditions acknowledge that ninetonine world assumes no responsibility for the agreement they enter into between them.
Therefore, ninetonine world is not responsible for the truthfulness and suitability of the ninetonine au pair positions offered by the host families, nor for the truthfulness, suitability, adaptability, honesty, character.
ninetonine world acts as an agent for introductions.
The ninetonine au pair in or au pair out is not, either directly or indirectly, employed or contracted by ninetonine world at any time.
ninetonine world acts solely as an intermediary between the client and the ninetonine world au pair in or ninetonine au pair out.
The Client acknowledges that he/she is responsible for all payments due to the ninetonine world au pair during the time the ninetonine world au pair is engaged by the Client.
ninetonine world will not accept any financial responsibility for any incidental or accidental costs incurred as a result of ninetonine world au pair in or ninetonine world au pair out being hired by the host family.
If the family requires the ninetonine au pair in or out to drive any means of transport, this will be the responsibility of the host family and ninetonine au pair world accepts no liability in this respect.
The cost of accidental damage to property, vehicles or other belongings caused by the ninetonine au pair in or out will be covered by the insurances taken out by the client.
In case of excess or uninsured accidental damage, the client must pay the additional or full cost of repair or replacement of the property. In no case may the ninetonine au pair in or out be forcibly withheld from the money received for personal expenses or reduced in order to cover the costs of accidental loss or damage. Neither the ninetonine au pair in or out nor his/her family shall be required to pay for any accidental injury or accidental damage to a vehicle driven by the ninetonine au pair in or out at the request of the client or with his/her permission.
ninetonine world is not responsible for any accident or incident that may happen to the ninetonine au pair in or out caused by any person or caused by the ninetonine au pair in or out to any person.
ninetonine world is not liable under any circumstances for any injury, loss, damage, dishonest or malicious acts, expenses, wilful (wilful or negligent) or involuntary act or omission or breach of the agreement entered into between the Host Family and the ninetonine au pair in or out that either party may incur, before, during or after entering into such agreement, or arising as a result of ninetonine world’s intermediation between the Host Family and the ninetonine au pair in or out.
Therefore, both parties expressly waive the right to take any judicial or extrajudicial action against ninetonine world.
ninetonine world disclaims all liability to any third party, anywhere in the world, for any injury, damage, direct or indirect loss, consequential or economic loss or any other loss suffered as a result of the use of or reliance on the information contained on its website, provided by the agency through any other means and/or for any of the services provided by ninetonine world to the fullest extent permitted by law.
Under no circumstances, including negligence, shall ninetonine world be liable for any incidental, special or consequential damages resulting from the use of its website or the services provided, even if ninetonine world or an authorized representative of ninetonine world has been advised of the possibility of such damages.
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.
If this occurs, ninetonine world’s total liability to you for all damages, losses and causes of action, whether in contract, tort (including negligence) or otherwise, shall not exceed the amount you have paid ninetonine world for its services.
CLIENTS’ OBLIGATIONS Host families and ninetonine in or out agree to abide by the laws in force in the host country.
The clients are solely responsible for the authenticity and legality of the information, texts and photographs that they insert in the documentation and undertake the obligation to respect the legal regulations in force and good manners.
Clients are solely responsible for the confidentiality of their information.
They must not include any information in their profile that they do not want third parties to see.
ninetonine world is not obliged to check customer profiles with regard to the influence they may have on the rights of third parties.
The data that clients obtain from other families/ ninetonine au pair are strictly confidential and, therefore, it is strictly forbidden to provide them to other clients or third parties, especially the contact details, should they have access to them. If the client, directly or indirectly, puts a candidate in contact with any other family and, as a result, a placement is established, the client will be responsible for the corresponding placement management fee.
VARIOUS ninetonine world reserves the right to transfer, in whole or in part, to third parties, the rights and obligations resulting from these Terms and Conditions, within the margins of the legislation in force.
In compliance with the Personal Data Protection Act of England ninetoninineworld will not disclose the personal and contact details of its clients, without your prior written consent, unless it is necessary to comply with the law or in legal proceedings where such information is relevant. By signing the agreement the host family, the ninetoninine in or out where appropriate acknowledges and agrees that in order to provide you with the appropriate services, ninetoninine world may share all information provided by you with third parties and collaborating agencies.
FINAL PROVISIONS These Terms and Conditions shall be governed by and construed under the laws of the United Kingdom.
In the event of any conflict between the translation of these Terms and Conditions into other languages, the English version shall prevail.

The clients are solely responsible for the authenticity and legality of the information, texts and photographs that they insert in the documentation and undertake the obligation to respect the legal regulations in force and good manners.
Clients are solely responsible for the confidentiality of their information.
They must not include any information in their profile that they do not want third parties to see.
ninetonine world is not obliged to check customer profiles with regard to the influence they may have on the rights of third parties.
The data that clients obtain from other families/ ninetonine au pair are strictly confidential and, therefore, it is strictly forbidden to provide them to other clients or third parties, especially the contact details, should they have access to them. If the client, directly or indirectly, puts a candidate in contact with any other family and, as a result, a placement is established, the client will be responsible for the corresponding placement management fee.
VARIOUS ninetonine world reserves the right to transfer, in whole or in part, to third parties, the rights and obligations resulting from these Terms and Conditions, within the margins of the legislation in force.
In compliance with the Personal Data Protection Act of England ninetoninineworld will not disclose the personal and contact details of its clients, without your prior written consent, unless it is necessary to comply with the law or in legal proceedings where such information is relevant. By signing the agreement the host family, the ninetoninine in or out where appropriate acknowledges and agrees that in order to provide you with the appropriate services, ninetoninine world may share all information provided by you with third parties and collaborating agencies.
FINAL PROVISIONS These Terms and Conditions shall be governed by and construed under the laws of the United Kingdom.
In the event of any conflict between the translation of these Terms and Conditions into other languages, the English version shall prevail.
